1. Agreement to Terms

By accessing or using Giver.ug, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this platform.

We reserve the right to modify these terms at any time. Your continued use of the platform after changes are posted constitutes acceptance of the modified terms.

2. Platform Description

Giver.ug is a community-driven platform that connects people who want to donate items with those who need them. Our service is strictly for free donations - no money should ever be exchanged through our platform.

We act as an intermediary to facilitate connections between users. We do not own, sell, or control the items listed on the platform.

3. User Accounts

3.1 Account Creation

To use certain features of Giver.ug, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Be at least 18 years old

3.2 Account Responsibility

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to maintain account security.

4. User Conduct

You agree NOT to:

• Request or accept payment for items (all donations must be free)
• Post false, misleading, or deceptive content
• Harass, threaten, or abuse other users
• Post illegal, harmful, or offensive content
• Violate any intellectual property rights
• Use the platform for commercial purposes without permission
• Spam or send unsolicited messages
• Attempt to hack, disrupt, or damage the platform
• Impersonate another person or entity
• Scrape or collect user data without permission
• List prohibited items (weapons, drugs, hazardous materials, etc.)

5. Item Listings

5.1 Giver Responsibilities

When posting items, you must:

• Own the item or have permission to give it away
• Provide accurate descriptions and photos
• Disclose any defects or issues with the item
• Follow through on commitments to donate items
• Remove listings promptly when items are no longer available

5.2 Prohibited Items

The following items may not be listed:

• Weapons, firearms, ammunition, or explosives
• Illegal drugs or controlled substances
• Prescription medications
• Stolen property
• Hazardous materials or chemicals
• Adult content or services
• Counterfeit or pirated goods
• Live animals (except through approved rescue organizations)

6. Transactions and Exchanges

6.1 No Platform Liability

Giver.ug is not a party to transactions between users. We do not verify the quality, safety, or legality of items. All exchanges are at your own risk.

6.2 User Responsibility

Users are solely responsible for:

• Inspecting items before accepting them
• Arranging safe meeting locations
• Ensuring items meet their needs and expectations
• Complying with all applicable laws
• Any disputes arising from exchanges

7. Intellectual Property

7.1 Platform Content

All content on Giver.ug, including text, graphics, logos, and software, is the property of Giver.ug or its licensors and is protected by copyright and other intellectual property laws.

7.2 User Content

By posting content on Giver.ug, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content on the platform. You retain all ownership rights to your content.

You represent that you have all necessary rights to post your content and that it does not violate any third-party rights.

8. Privacy

Your use of Giver.ug is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

9. Disclaimers

Giver.ug is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the platform will be uninterrupted or error-free
• Warranties regarding the quality, safety, or legality of items
• Warranties about the accuracy or reliability of user content

10. Limitation of Liability

To the maximum extent permitted by law, Giver.ug and its operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Your use or inability to use the platform
• Any items received through the platform
• User conduct or content
• Unauthorized access to your account
• Any other matter relating to the platform

11. Indemnification

You agree to indemnify and hold harmless Giver.ug and its operators, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the platform, your violation of these terms, or your violation of any rights of another party.

12. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including violation of these terms. Upon termination:

• Your right to use the platform will immediately cease
• We may delete your account and content
• You remain liable for any obligations incurred prior to termination

13. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Uganda, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Uganda.

14. Dispute Resolution

In the event of any dispute arising from these terms or your use of the platform, you agree to first attempt to resolve the dispute informally by contacting us. If the dispute cannot be resolved informally, it shall be resolved through binding arbitration in accordance with Ugandan law.

15. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
